Inheritances and estates

For private clients (private individuals, spouses, families, patchwork families, entrepreneurs, etc.) we act as advisors and negotiators, planners and/or litigators in the field of inheritance law. If required, we advise you on planning and implementation of your own family- and inheritance situation. In doing so, we protect the interests of individuals during their lifetime as well as – after death – the interests of individual heirs, several heirs and/or communities of heirs. We focus on tailor-made and individual solutions for the planning and implementation of asset succession as well as for the lifetime protection of private assets.

Estate settlements and execution of wills etc.

We carry out estate settlements and the division of estates so that communities of heirs can be terminated and dissolved, with each heir receiving their share (in the form of liquid assets and/or tangible assets). If required, we take over and manage inheritance law functions such as execution of wills, representation of heirs, administration and liquidation of estates.

In case of long-lasting inheritance relationships, we advise on the existing rights and obligations of persons involved and point out possible courses of action and solutions (e.g. with regard to unauthorized actions, refusal to provide or obtain information, free occupation of estate property, dealing with difficult executors, but also with regard to lifetime contributions/grants etc.).

Litigation and dispute resolution

If necessary, we represent our clients in inheritance law proceedings and litigation, for example regarding the division of estates, contesting wills (e.g. due to dementia situations/incapacity to judge, influence, formal problems, etc.), enforcement of legacies, reducing grants or safeguarding statutory entitlements, etc. If reasonable and the circumstances permit it, we advocate consensual solutions in court proceedings in order to avoid long and cost-intensive civil proceedings.

Estate planning and lifetime arrangements

If required, we advise on the protection of assets in a self-determined manner with regard to a possible future incapacity to judge (e.g. due to dementia disease), for example by setting up an advance care directive and/or designating a desired deputyship, etc.).

Furthermore, we advise on all questions of estate planning and provide support in the implementation of the phrased ideas and wishes (e.g. by drafting/notarizing wills, marriage and inheritance contracts, advance care directives, special and general powers of attorney, etc.). Notarial deeds are carried out by our professional team of notaries.
